國際反死刑委員會(ICDP) 針對台灣槍決五名死囚的聲明/ Statement by the ICDP on the Executions of Five Prisoners in Taiwan (20110307)

編按:國際反死刑委員會(ICDP)於2010年10 月10日的世界反死刑日成立,總部設在西班牙馬德里。現任的主席Federico Mayor曾經擔任過聯合國教育科學文化組織(UNESCO)的秘書長,此外包括帶領法國廢除死刑的前司法部長Robert Badinter、前瑞士總統Ruth Dreifuss、擔任過兩任義大利總理目前是World Justice Project榮譽主席的Giuliano Amato以及前聯合國人權事務高級專員Louise Arbour...都是成員。ICDP的目標是推動2015年達成全球零死刑的目標。

台灣於2011年3月4日槍決了五名死囚,國際反死刑委員會(ICDP)對此表示強烈的譴責。

日前才爆發江國慶冤案,且台灣總統和國防部長公開道歉,彷彿是個契機,但不到數週,台灣政府很快又執行死刑,ICDP對此感到遺憾。處決無辜者,這對於所有仍維持死刑制度的國家,包括台灣,應該要引以為戒,因為不管一個司法體制再怎麼健全,都不可能完全排除掉錯殺的冤案。

死刑損害人性尊嚴,並違反《普世人權宣言》中所認可的生存權,且不管罪行有多麼嚴重,任何情況下都不應該適用死刑。再者,所謂死刑的嚇阻效果,根本就不存在有這方面的佐證資料。

ICDP呼籲台灣當局要以一種全面廢除死刑的觀點,毫不遲疑地宣布暫停執行死刑,這和全球朝向廢除死刑的國際趨勢是站在同一陣線,聯合國大會於2010年12月21日正式通過65/206號針對中止使用死刑的決議案,該案肯認了全球廢死的趨勢。

Statement by the
International Commission against the Death Penalty
on the Executions of Five Prisoners
in Taiwan

The International Commission against the Death Penalty (ICDP) strongly condemns the executions of five prisoners in Taiwan which were carried out on 4 March 2011.

ICDP regrets that these executions were carried out only a few weeks after the revelation of the wrongful execution of Chiang Kuo-ching, as it read the public apology by the Taiwanese President and Minister of Defence as signs of hope. The execution of an innocent person should be an example for all the countries that still have the death penalty in their law books, including Taiwan, because no justice system – no matter how developed it might be – is able to rule out the execution of an innocent person.

The death penalty undermines human dignity and violates the right to life recognized by the Universal Declaration of Human Rights and it should not be applied whatever the circumstances, regardless of the gravity of the crime. Furthermore, there exists no conclusive evidence on the deterrent effect of the death penalty.

ICDP calls on the Taiwanese authorities to declare a moratorium on executions without delay with a view to its total abolition, in line with the worldwide trend towards the abolition of capital punishment confirmed by the UNGA Resolution 65/206 on a Moratorium on the Use of the Death Penalty adopted on the 21 December 2010.
